Restructuring and Bankruptcy
Together, the professionals of Trenk DiPasquale have more than two centuries of experience in the practice of financial restructuring, creditors’ rights, and insolvency. The firm is highly regarded by both the judiciary and the bar in this specialized practice area, which includes debtor, creditor, and fiduciary representations in federal bankruptcy cases; pre-bankruptcy “workout” and insolvency counseling; and related state court litigation involving receiverships, attachments, replevins, and commercial foreclosure actions.
We have the insight and versatility of having represented all major constituencies in chapter 7 and chapter 11 cases, including debtors, trustees, official committees, secured and unsecured creditors, landlords, asset purchasers, insurance carriers, equity interests, governmental entities and other parties in interest. We know equally well how to confirm chapter 11 plans and how to maximize the return to creditor clients under plans proposed by others, all at a reasonable cost.
Members of the firm’s Restructuring and Bankruptcy group have distinguished themselves in a variety of ways in the field. For example, partner Henry M. Karwowski is the author of New Jersey Bankruptcy Rules Annotated, the leading guide to the rules governing bankruptcy practice and procedures in New Jersey. Partner Andrea Dobin is a panel chapter 7 trustee and the standing chapter 12 trustee in the Trenton vicinage of the New Jersey Bankruptcy Court. Both Andrea and partner Joseph J. DiPasquale have been appointed as chapter 11 trustees. In addition, several partners of the firm, including Richard D. Trenk and Anthony Sodono III, have served as custodial receivers and assignees for the benefit of creditors in state court. Both Anthony Sodono III and partner Sam Della Fera, Jr. act as Bankruptcy Court-approved mediators, and Sam is a member of the steering committee of the Hon. Morris Stern Bankruptcy Pro Bono Project at Rutgers Law School.
Members of the department regularly earn accolades from the most respected and prestigious peer-review publications in the industry, including the National and Worldwide Chambers USA Guide, the regional Best Lawyers®, Super Lawyers and Super Lawyers Rising Stars rankings. In 2015, associate Joao F. Magalhaes was singled out by the New Jersey Law Journal as a New Leader of the Bar.
