Chapter 11 Plan Confirmed

On March 21, 2012, the United States Bankruptcy Court for the District of New Jersey confirmed the reorganization plans filed by chapter 11 debtors Joel Tanis & Sons, Inc. and Oak Ridge Service Corp. t/a Service Concrete Company, two well established Redi-Mix Concrete suppliers located in Fair Lawn and West Milford, New Jersey. The cases were brought to a speedy conclusion only four months after they were initiated. Secured and unsecured creditors agreed to over $20 million in debt concessions, and allowed unsecured creditors will receive a 25% dividend paid over the course of five and a half years. The companies and their Sparta affiliate, which have been in business for over 50 years and employ more than 100 people, serve Passaic, Hudson, Essex, Sussex and Bergen counties. Partners Richard D. Trenk and Joshua H. Raymond represented the companies, and Partner Joseph Maddaloni assisted in collective bargaining negotiations.

TD’s Client Prevails in Bid Contest

On March 26, 2012, the Appellate Division reversed a trial court’s ruling and determined that a bidder which was not in compliance with either New Jersey Diesel Retrofit Program regulations or applicable bid specifications was not a responsible bidder for certain solid waste collection and recycling contracts in the City of Bayonne. Richard D. Trenk represented Plaintiff Suburban Disposal, Inc., another bidder, in the matter.

TD Honors Captain Justin Talley

Trenk, DiPasquale, Della Fera & Sodono, P.C. recently honored Captain Justin Talley for his service to the country.

During his deployment in Afghanistan, the firm sent Captain Talley and his unit a weekly care package of amenities and necessities. Upon his return, the firm hosted a luncheon at which Captain Talley shared his experiences and observations and presented the firm with a flag that had been flown by an unmanned aerial vehicle during actual operations in Afghanistan and with a “Commander’s Coin.” Captain Talley is the husband of Jennifer D. Talley, an associate at the firm.

TD proudly welcomes new partners Marc J. Derewetzky and Joel Max Eads. Mr. Derewetzky will practice from the Firm’s new Oakland, CA office. Mr. Eads will practice from the Firm’s new Philadelphia area office.

Marc J. Derewetzky

Marc Derewetzky will be a Resident Partner in the Firm’s Oakland, California office.

Mr. Derewetzky concentrates his practice in the areas of insurance coverage and bad faith litigation.

Mr. Derewetzky litigates sophisticated insurance, admiralty, contract, product liability, bankruptcy, environmental, and other matters throughout the western United States. He has litigated several jury trials and has successfully argued cases before the United States Court of Appeals for the Ninth Circuit and the California Courts of Appeal.

Mr. Derewetzky was a founding member, and he served as Managing Partner, of Morison Holden Derewetzky & Prough, LLP, a boutique commercial litigation firm specializing in insurance coverage matters. Also, he was a partner at Hancock, Rothert & Bunshoft (now Duane Morris), at which he was primarily responsible for large exposure insurance coverage matters on behalf of both Underwriters at Lloyd’s and certain London Market Insurance Companies.

Mr. Derewetzky is a contributor to the California Practice Guide for Insurance Litigation.

Joel Max Eads will be a Resident Partner in the Firm’s greater Philadelphia area office.

Mr. Eads concentrates his practice in the areas of commercial litigation, insurance coverage, and bad faith litigation.

Mr. Eads represents all varieties of clients in sophisticated insurance, pharmaceutical, telecommunication, investment banking, auto manufacturing, securities, contract, unfair competition, partnership, employment, shareholder, product liability, commercial tort, class action, and other matters. He has litigated cases in 13 states and 14 federal jurisdictions.

Mr. Eads previously was a member of Morison Holden Derewetzky & Prough, LLP.
